How to apply for a Canada PR Visa as a married couple

Many aspiring immigrants struggle to bring their families along with them, but when it comes to Canada, this is not the case. Various pathways allow you and your spouse to migrate simultaneously, no matter whether you both obtain Canada PR at different times.

From the Canadian spousal sponsorship program to traditional options of your partner joining you in Canada as a dependent, there are different pathways to apply for Canada PR as a couple. Canada considers all the Spousal relationships for immigration purposes, including same-sex couples and common-law partners.

Let’s find the right program for you to begin the Canada PR process

It is one of key pathways to Canadian immigration and is divided into three federal economic immigration programs:

  • Federal Skilled Workers Program
  • Federal Skilled Trades Program
  • Canadian Experience Class

Couples who apply via Express Entry can follow any one of two options:

One partner can be the principle applicant and lists the spouse, conjugal or common-law partner as dependent or can make them secondary-applicant.

  • Apply with a principle and secondary applicant

Under this process, the principal applicant must submit enough proof of funds, but, the secondary partner is also seen as a contributor. This means that once you create an Express Entry profile, you get a CRS score out of 1,200 points, out of which your partner’s profile determines 40 points. This can indeed make a huge difference in improving your overall CRS scores.

It is essential to consider all the key points and decide which partner’s most vital profile before applying as the principal applicant.

*You can take a free profile assessment to determine whose scores are likely to be high.

  • Applying with Dependents

If you choose to include your partner as a dependent in your Canada PR application, you, as a primary applicant, must submit enough proof of funds. In addition, settlement proof is required as evidence that you can financially support your dependent partner in Canada.

Please note that you need proof of funds only if you are applying under Federal Skilled Worker Program or Federal Skilled Trades Program.

The amount of money required to support your family depends on your family size, which includes:

  • yourself
  • your spouse or partner
  • your dependent children and
  • your spouse’s dependent children

Canada PR visa fees includes the following:

  • Processing fees (for you, spouse you’re sponsoring and their dependents)
  • Right of permanent residence fee
  • Biometrics fee

Spousal Sponsorship

This is, so far, the fastest pathway to bringing a partner to Canada. Being a part of Canada’s Family Class immigration program is considered the best option for those already living in Canada as PR holders or Canadian Citizens. Such individuals can bring their spouse or partner to Canada by sponsoring them for permanent residency.

In order to qualify as a sponsor, you must

  • Age 18 years or above
  • Be a Canadian permanent resident or citizen
  • Be able to support your sponsored partner financially
  • Ensure that your partner doesn’t need any social assistance from the Canadian government

How to protect yourself against Canadian Immigration Fraud?

by By Rajneesh Kumar

How to protect yourself against Canadian immigration fraud

As an aspiring immigrant who desires to work and live in Canada, you have to go through a stringent immigration process and be prepared for each stage. If you hire a Canadian Immigration Consultant who can support you throughout the process, you need to be extra careful before choosing one. Your key responsibility is to ensure the authenticity of the visa consultancy company you desire; otherwise, you may fall prey to fraudulent practices.

To help you out, we came up with a few essential tips so that you can identify and choose a genuine, trusted immigration advisor and consultant in India and prevent any immigration fraud.

Essential Tips to Choose Trusted Canadian Immigration Consultant in India:

  • Always sign a government-issued “Use of a Representative Form (IMM5476). This form confirms that the hiring consultant is authorized to represent an immigration case. It comes in varied sections like your first & last name, date of birth, first & last name of your Immigration Consultant, their ICCRC Membership ID number, address, etc.
  • Always get copies of all the forms you and the consultancy company have dated and signed. It is required for future record and reference purposes.
  • Be aware that the consultant is compelling you to make any cash payment, as it is pretty challenging to track the same. Generally, cash payments don’t have must documentation that you can produce evidence of making payment for certain services. Always choose authorized and traceable modes of payment like cheque, credit card, bank transfer, etc., which get reflected in a bank statement.
  • Ensure that you get invoices and receipts for all the payments you have made and that the amount is outlined in the Retainer Agreement you sign.
  • Beware of those who guarantee you visa approval or a job in Canada. Always remember, no one can guarantee the application results. The final decision is always at the discretion of IRCC’s visa officers on every application, and they never share any information in advance.
  • Beware of those who assure about any tie-up with the Immigration Department of Canada to get help regarding your immigration file. The visa officers at IRCC assess and process all the applications as per the strict protocol and take an independent decision based on the candidate’s merit, documentation and evidence provider. No one, at any point, influences their decision.
  • It is recommended to check ICCRC’s registration and be alert if the logo of an ICCRC corporate is not visible on an immigration website or there is any link that leads you to ICCRC’s website to verify the registration. Always look for a registered immigration advisor and consultant company in India and do a detailed background check, like customer testimonials, terms and conditions, return policy, etc.
  • Always beware of those who guarantee you a real processing time for your visa application. There is no fixed timeline for processing any application under any visa category. The IRCC always provide a stipulated period, but no one can guarantee it. The time varies based on a case-by-case basis. For example, there could be a delay in processing your application for different reasons, like missing documents, incomplete information, etc.
  • Beware of those who charge you for any service other than immigration, for instance, a job placement. A regulated Canadian Immigration Consultant is licensed to provide only immigration services. If a person or company is offering you a job placement under a different contract, perform a proper check and ensure that they are certified recruiters and licensed to provide job placement services.

Keeping in mind the prevalent fraud cases, Canada came up with a regulatory body responsible for regulating the consultants. It was introduced in 2019 and is primarily accountable for identifying and controlling the malpractices and fraudulence performed by an immigration consultant.

If you aspire to move to Canada permanently, consider the points mentioned above before choosing an immigration consultant.

Is it challenging to apply for Canada PR Visa in 2022?

by By Rajneesh Kumar

Posted on May 9, 2022

Is it challenging to apply for Canada PR Visa in 2022

Canada is undoubtedly one of the best destinations to immigrate to for a newcomer. From infrastructure and robust economy to immense job opportunities and top wages, Canada attracts thousands of applicants every year for permanent residence.

However, many Canadian immigration applications get refused as well for various reasons, a lot of which are entirely avoidable. Such unfortunate circumstances usually result in causing distress and disappointment for aspiring immigrants and their family members.

The reason behind such situations is a lack of proper knowledge! Since Canada offers a plethora of immigration options for skilled foreign nationals, it sometimes becomes challenging for a person to navigate through a detailed process.

Therefore, we came up with seven typical reasons why Canada PR visa applications get refused. This can help you or anyone who is thinking about immigrating to Canada.

7 reasons why Canada PR visa applications get refused:

An Act of Misrepresentation

It has been observed that many cases of misrepresentation find their way when an applicant misreads or misunderstands a question on the form, omits key information from a record, or misunderstands specific instructions regarding form completion.

The term ‘misrepresentation’ implies a scenario where a person deliberately hides or alters any specific information. But, this cannot be the case always. In some instances, it can be accidental as well as preventable. But, it would help if you took care of it well in advance; otherwise, your application will be refused by the IRCC out rightly, and in some cases, you may be banned for up to 2 years from reapplying.

Medical Conditions

As a primary applicant for a Canada PR visa, you and your dependents (if any) must undergo a medical examination done by an IRCC (Immigration, Refugee, Citizenship Canada) recognized doctor.

In case of certain health conditions, you may face refusals, like Diabetes or Hepatitis A. However, there are ways through which you may overcome the inadmissibility to Canada on health grounds. For instance,  you may produce a report from a specialist about your health condition that can help you avoid further examinations, application refusal or delay in processing.

Criminal Background

A criminal background check is a must in each country you reside in for more than six months from the day you turn 18 years. It is a mandatory requirement because Canada wants to make sure that you, as a newcomer, will not impose any security threat to the health and safety of its residents and citizens. If you prove that there was no charge or conviction on you in the past, then IRCC will process your application as per the standard protocol and timeline.

You may be inadmissible to Canada on criminal grounds as a foreign national. In addition, any past conviction on you can cause your application to be rejected.

Missed deadlines

The Immigration, Refugee, Citizenship Canada (IRCC) ensures that the entire immigration process is fair. Thus, deadlines are also imposed on the applicants to submit documents and specific forms. If you miss out on any of these deadlines, it may result in application refusal.

Therefore, you need to know the right time to obtain the required documents and complete specific forms beforehand. But, trust us, it is possible to get things done as per the deadline. All you need is to be prepared and organised to kick-start the immigration process on time and avoid application refusal.

Reconsiderations

There are certain cases where the IRCC consistently follows its own rules and protocols. However, a visa officer can commit any error or inconsistencies while assessing the applications. Sometimes they may misinterpret the rules and refuse your application on invalid grounds.

Hiring a visa and immigration advisory service can help ease the problem in such situations. A registered consultant may help build a case file based on established models similar to most of the conditions faced by applicants who got their application refused. This will help you represent a better case for reconsideration or appeals.

Incomplete documentation

The IRCC provides a detailed documentation checklist to an applicant and a tracking number for application completion. You are responsible for gathering all those documents and submitting them on time with the tracking number. If you fail to submit complete documents, you may face application refusal.

Unclear about Eligibility Criteria

With more than 80 immigration programs, each Canadian immigration program has unique selection requirements. As a result, an applicant’s eligibility for the chosen program is assessed based on factors like age, education level, occupation, language skills, work experience, etc.

A lack of proper knowledge about the essential eligibility criteria for the chosen program might disqualify you. Sometimes an applicant gets their application refused because the IRCC finds that the applicant is not eligible for the immigration program under which they have applied.

Thus, you must thoroughly review the application criteria against your profile details and undergo an online profile assessment before applying for any immigration program. Detailed profile assessment is the best solution to avoid such instances.

Are you interested in moving to Canada this year?

To conclude, we would like to say that obtaining Canada PR can be an easy affair if you overcome the challenges mentioned above. You may also join hands with India’s top visa and immigration consultancy company, i.e. Visas Avenue. Canada is a beautiful country and is the world’s second-largest country for its size. It is considered as an ideal destination for aspiring immigrants who want to move for better career prospects and living standards.

However, the key question that pops up in a person’s head when they think about making a move is, “wherein Canada I should move to?”. With ten provinces and three territories, the decision can be challenging. After deciding, an individual may refer to an online Canada PNP Tracker and find out which provincial nominee programs are accepting applications.

But, as mentioned, before you apply for Canada PR Visa, you must choose a province where you are interested in moving. Thus, to help you find out the best Canadian province where you can live with your family, we have came up with a list of top 5 provinces in Canada.

  1. Ontario

Ontario is a home to beautiful cities and serene towns, which offers something for everyone. Being one of the most versatile provinces in Canada, you can enjoy living in a big city like Toronto and Ottawa to experience the happening nightlife or be a part of small town like Newmarket to enjoy a relaxed life.

Additionally, Ontario is a great destination for international students as well. The province has a few finest universities in North America, including the University of Toronto, University of Waterloo and McGill University. All three are among top fifty universities of North America.

  1. British Columbia

British Columbia is Canada’s second-largest province for its population and size. British Columbia is known for its picturesque natural surroundings, and there are a lot of great cities you can move to and live a better life with family.

With many provincial parks and national parks, you can channel the nature lover in you in British Columbia. You can experience mountain climbing, biking, skiing, kayaking, snowboarding, etc. But, that doesn’t make British Columbia a perfect place for winter sports; the province also has beautiful beaches for you to have summertime fun in clear and cold water.

Also, B.C. is home to Vancouver, one of the most lively cities in Canada, which is also named among the world’s best cities to live in. The city is safe and offers excellent job opportunities and a high standard of living at an affordable cost.

Not only this, Alberta’s employment rate is significantly high, and there is a constant creation of jobs in sectors like retail, automotive service, tourism, contractors and health workers.

What adds a feather to Alberta’s reputation as one of the best Canadian provinces is that there is no provincial sales tax. The tax on goods is nearly 5% compared to another province named Prince Edward Island, where the tax rate is around 15%.

  1. Saskatchewan

Located in the centre of Canada between Manitoba and Alberta, Saskatchewan is quite a fun place to enjoy activities like camping, hunting and fishing.

Also, when in Saskatchewan, you can live a comfortable life, thanks to its lowest cost of living in Canada. The cost of housing, schooling and healthcare is reasonable enough to manage your expenses effectively.

IRCC inviting nearly 3,000 candidates in every Express Entry draw

The IRCC has been consistent in terms of the number of invitations issued per Express entry draw this year. In almost each Express Entry draw launched this year, IRCC has invited 3,000 candidates, which quite remarkable thing noticed. In fact, in last four EE draws, IRCC has invited 12,000 express entry applicants (i.e. precisely 3000applicantsper draw), while in first 2 draws it invited 2,750 candidates each draw. These numbers are commendable despite no real reduction in qualifying marks.

The qualifying marks are expected to reduce in upcoming draws

Although, the qualifying marks or CRS score requirement in the express entry is hovering around 440s, however, it is expected to decrease significantly in the forthcoming draws of express entry system.

Last EE draw held on March 26, 2018, the IRCC decreased CRS score requirement by 10 points, which was 456 CRS points in the EE draw occurred prior to that. This is good sign from the perspective of Express Entry applicants eagerly waiting for the fall in qualifying marks. The CRS score requirement is expected to decrease further considering the massive annual immigration target set by IRCC for 2018.

Click here to view complete list of Express Entry Draws till date

Massive Immigration target in 2018

In its Multiyear Immigration plan (2018-2020) revealed in November last year, IRCC announced the annual immigration target of 310,000 permanent residents for the year 2018. Out of the total number 74,900 people will be invited through Federal Express Entry system.

At this point, ICC needs to invite 57,400 more applicants in next 9 months via 18 express entry draws (considering the 15-day cycle of EE draws). Which means, the IRCC will have to invite over 3,100 applicant per draw from now onwards to meet Express Entry immigration target for 2018.

Statistics suggest the reduction in CRS score requirement

IRCC may be having the candidates with CRS score around 450 at now, however, it is likely that in future, IRCC will have to drop the CRS score requirement. Considering the CRS score of the applicants at that point of time, IRCC is likely to reduce qualifying marks, as it cannot compromise with immigration target.

Nominate for Canada PR Visa

Want to move to Canada, but not aware about main pathways?

Well, Canada is probably the only country, which is constantly relaxing its immigration rules and procedures, despite the adverse immigration scenario across the world.

Canada welcomes Immigrants

It has got a point based system for immigration, through which it invites the suitably skilled workers in the country. Yes, it’s true that it needs skilled workers, but so are the other advanced nations. Provincial Nominee Pathway for immigration to Canada

Canada is a home to total of 10 Provinces and three territories. Most of the provinces in Canada have got a Provincial Nominee Program (PNP) through which they select suitable skilled workers for their labour market.

How to get the nomination from a province for Canada PR

There two ways to get the provincial nomination for Canadian Permanent Residency (PR):

  • Express Entry pathway
  • Apply Directly in a PNP

Let’s try to understand both these pathways of obtaining Canadian Permanent Residency.

Express Entry Pathway

In this method, you first need to register a profile in Federal Express Entry System and find place in Express Entry pool of candidates. Also, remember to select the option of ‘all provinces and territories’, when the system asks you for a preferred province for immigration.

Express entry is also a popular pathway of obtaining Canada PR. It also provide pathway for obtaining the nomination from a Canadian PR Visa:

  • What is Express Entry system?

Express Entry is the online point-based immigration system of Canada. It is based on a CRS (Comprehensive Ranking System), which assess the profile of an applicant based on age, education, work experience, etc. criteria.

  • How it works

The PNPs have access to Express Entry pool. If your profile is found eligible a PNP can send you NOI (Notification to Interest) to apply in its Express Entry Stream. Once you receive a NOI, you need to apply in the express entry stream of that particular PNP and if you are selected you will get additional 600 points in federal express entry system. Such huge additional CRS points ensures that you get ITA (Invitation to Apply) from IRCC (Immigration Refugees and Citizenship Canada) in the subsequent draw of express entry system.

Direct apply in a PNP

In this pathway, you have to directly apply in a Provincial Nominee Program and pass through its selection system. Many PNPs have other popular streams as well apart from express entry stream, i.e. Occupation in Demand category or stream. You can apply in the most relevant stream and if you are selected you will get provincial nomination to apply for Canada PR.

Once you have got a nomination from a province for Canada PR, you need to apply for permanent residency directly to IRCC. The IRCC will only verify your documents and certificates with regards to medical condition and character, etc.If all goes fine you will get approval of PR visa.

Having said that, Canada has undergone several immigration rule changes in the last couple of years, especially, after the Liberals took over the charge and formed the cabinet at centre. Hence, many applicants are confused about the status and often seen asking question, i.e.

What is the probability of obtaining Canadian PR Visa from India?

As already mentioned above, the Canadian government has transformed the immigration system of Canada in the last couple of years. Fortunately, all these changes in last 2 years have been positive from immigrants’ point of view. The government is willing to invite more and more applicants today. This, in fact, is evident from the Annual Immigration Target of Canada for last two years (i.e. over 300,000). The government has also modified the immigration rules and guidelines to make Canada immigration pathways relatively simpler for tens of thousands of people looking to get PR in Canada through different channels.

The government has also been lenient on family members of the immigration applicants as well as immigrants settled in Canada. It is evident from below two announcements of the Canadian government within last one year.

  • Family sponsored visa-processing time reduced to 12 months from 24 months.
  • The annual quota of Parent and Grandparent Visa applications increased from five thousand to ten thousand.

The year 2017 has been Outstanding in terms of Massive Canada PR Invitations issued

The government continued to relax immigration requirement in the year 2017 as well. The IRCC (Immigration Refugees and Citizenship Canada) has implemented a few key changes to federal express entry immigration system this year.

The other good thing that IRCC has done in the favour of Canada immigration applicants this year is a considerable reduction in the cut off marks (CRS Score requirement) vide Express Entry Draws. As a result, a massive number of applicants registered in federal express entry system got the invitation to apply for permanent residency in Canada. This year, until July 2017, close to 55,000 applicants received the ITA (Invitation to Apply) for Canada PR from IRCC.

Canada PR via Express Entry or Student Visa? -Which One to Choose for Immigration to Canada

by By Rajneesh Kumar

Posted on May 24, 2017

Immigrate to Canada

Canada is one of those countries that have the history of immigration. It invites and welcomes immigrants from all parts of the world without any discrimination. A reasonable part of its population is immigrants or has the origin outside Canada. However, tens of thousands of people who aspire to move often get confused about choosing the right visa program to immigrate to Canada.

The question that puzzles most Canada immigration aspirant is whether to choose student visa or Permanent Residency (PR) for immigration to Canada.

Canada PR via Express Entry

This is the most popular pathway for Canada immigration. Every year, tens of thousands of people register on federal express entry system and subsequently, get PR in Canada. It’s one of those permanent residence programs of Canada, which doesn’t compulsorily need Sponsorship from Canada from applicants. Express entry is the federal immigration program of Canada. It is an online immigration system, which is based on CRS (Comprehensive Ranking System). The CRS reviews the registered express entry applicants based on their age, education, experience, language skills, etc. factors and accordingly give them a definite point score called CRS score.

Also Read- Which is the Best Canada Immigration Program to Get Canada PR in 2017?

Candidates with top CRS score get the ITA (Invitation to Apply) for Canadian Permanent Residency (PR) from Immigration Refugee and Citizenship Canada (IRCC) in its fortnightly draws. This year IRCC has drastically reduced the qualifying marks or CRS score requirement from applicants in all the periodic draws of express entry system. Hence, this year, more than 40,000 candidates have received ITAs (Invitations to Apply) for Canada PR till May 17, 2017. So, we can say that year 2017 is the best time to apply for Canada PR via federal express entry system.

Moving to Canada via Student Visa

To move to Canada on the student visa, you must apply and get accepted by a particular Canadian educational institution to pursue a definite course of study. As per the recent immigration rule changes by the Canadian government, you can also get CRS points for your Canadian educational credentials, to apply for PR via federal express entry system. However, once you move to Canada on the student visa, you must have money to support your stay as well as pay your tuition fee. Moreover, since you will not be having a professional opportunity ready right away, managing expenses can be tough on you as a new immigrant in Canada.

Hence, if you are eligible to apply for Canada PR via express entry system, and have good CRS score as well in express entry system, wise thing is to apply for PR and not the student visa in Canada.
